§1. Preliminary provisions

- rules of using the Online Store,
- rules for placing orders,
- rules for concluding distance sales contracts,
- delivery and payment rules
- complaint rules,
- rules for withdrawal from the contract,
- principles for the provision of electronic services.
- The Regulations are available free of charge on the Store's website in a way that enables their acquisition, reproduction and recording.
§2. Definitions
The terms used in the Regulations mean:
- Seller - TRAKTOR.COM.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Tajęcina, Tajęcina 2KA, 36-002 Tajęcina, entered into the register of entrepreneurs of the National Court Register under the number 0001077811, NIP 5170442917, REGON 527292090.
- Store – online store run by the Seller at https://traktor.com.pl.
- Customer – a natural person, a legal person or an organizational unit with legal capacity making purchases in the Store.
- Consumer – a natural person concluding a legal transaction with the Seller that is not directly related to his or her business or professional activity.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to his/her business activity, when the content of this contract shows that it is not of a professional nature for this person.
- Goods – movable item offered for sale in the Store.
- Sales contract – Goods sales contract concluded between the Customer and the Seller via the Store.
- Electronic service – a service provided electronically by the Seller to the Customer via the Store.
- Account – a set of data and functionalities assigned to the Customer after registration in the Store.
- Newsletter – electronic service consisting in sending commercial, marketing or organizational information to the provided e-mail address, after giving appropriate consent.
- Working days – days from Monday to Friday, excluding public holidays.
§3. Types and scope of services provided electronically
- The Seller provides the following electronic services via the Store:
- enabling you to place an order,
- enabling the creation and management of an Account,
- enabling subscribing to the Newsletter,
- enabling contact with the Seller via the forms available in the Store.
- Electronic services are provided free of charge.
- Agreement for the provision of electronic services:
- within the scope of the order form - is concluded for a specified period of time and is terminated when the order is placed or its submission is interrupted,
- in terms of maintaining the Account - is concluded for an indefinite period at the time of registration,
- within the scope of the Newsletter - is concluded for an indefinite period of time upon subscribing to the Newsletter.
- The Customer may terminate the use of electronic services at any time, and in the case of an Account or Newsletter, terminate the contract by sending an appropriate request to the following address: info@traktor.com.pl.
§4. Terms of use of the Store
- To use the Store you need:
- device with Internet access,
- up-to-date web browser that supports cookies and JavaScript,
- active e-mail address.
- The Customer is obliged to use the Store in a manner consistent with the law, good practices and the provisions of the Regulations.
- The customer is obliged to provide true and current data.
- The Customer is prohibited from providing illegal content.
§5. Rules for placing orders
- Orders in the Store can be placed 24 hours a day, 7 days a week.
- To place an order, the Customer:
- selects the Product and adds it to the cart,
- goes to the order form,
- provides data necessary to complete the order,
- chooses the delivery and payment method,
- accepts the Regulations,
- confirms placing the order.
- The information presented in the Store constitutes an invitation to conclude a contract within the meaning of the Civil Code.
- Placing an order constitutes an offer to conclude a Sales Agreement.
- After placing the order, the Seller sends the Customer an e-mail confirming receipt of the order.
- The sales contract is concluded when the order is accepted for execution by the Seller and the confirmation of order acceptance is sent to the Customer.
§6. Prices and payment methods
- All prices given in the Store are gross prices and include VAT, if applicable.
- Delivery costs are indicated to the Customer when placing the order.
- The Seller allows the following payment methods:
- traditional transfer to the Seller's bank account,
- electronic payment via payment operators available in the Store,
- card payment, if such an option is available in the Store,
- cash on delivery, if this option is available for a given order.
- Current bank account details are published in the Company data tab or provided to the customer when placing an order.
- If you choose to pay by traditional transfer, the Customer should make the payment within 7 days from the date of conclusion of the Sales Agreement, unless the parties agree otherwise.
- Failure to pay on time may result in cancellation of the order.
§7. Delivery and order fulfillment
- Orders are fulfilled within the territory of Poland, and in the case of foreign deliveries - after individually agreed conditions.
- The order processing time is given with the Goods or when placing the order.
- The total order processing time includes the order preparation time and the delivery time by the carrier.
- Delivery of the Goods takes place via carriers available in the Store or by personal collection, if such an option is offered.
- After receiving the shipment, the Customer should, if possible, check the condition of the packaging and contents of the shipment. If damage is found, it is recommended to prepare a damage report in the presence of the carrier and immediately contact the Seller. The lack of a damage report does not deprive the Customer of the right to make a complaint.
§8. Compliance of the Goods with the contract and complaints
- The Seller is obliged to deliver the Goods in accordance with the contract.
- Toward the Consumer and the Entrepreneur with consumer rights, the Seller is liable for the lack of compliance of the Goods with the contract on the terms arising from the Consumer Rights Act.

- The complaint should include:
- Customer identification data
- order number,
- description of the non-compliance of the Goods with the contract,
- Client request.
- Requirements from section 4 are of auxiliary nature and their absence does not affect the effectiveness of the complaint.
- If consideration of a complaint requires delivery of the Goods, the Customer will be informed about the method of transferring the Goods.
- The Seller responds to the complaint within 14 days from the date of its receipt.
- In relations with Customers who are not Consumers or Entrepreneurs with consumer rights, the Seller's liability under the warranty may be excluded on the terms permitted by law.
§9. Withdrawal from the contract
- The Consumer and the Entrepreneur with consumer rights may withdraw from the Distance Sales Agreement within 14 days without giving a reason.
- The deadline for withdrawal from the contract runs from the date the Customer or a third party indicated by the Customer, other than the carrier, takes possession of the Goods.
- In order to exercise the right to withdraw from the contract, you must submit a clear statement to the Seller:

- The customer may use the model withdrawal form attached to the Regulations, but this is not obligatory.
- The customer should return the Goods immediately, no later than within 14 days from the date of withdrawal from the contract.
- The return of the Goods should be sent to the following address:

36-002 Tajęcina - The Customer bears the direct costs of returning the Goods, unless the Seller agrees to bear them.
- The Seller returns to the Customer all payments received, including the costs of the cheapest standard delivery method offered in the Store, immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.
- The Seller may withhold the refund until it receives the Goods back or provides proof of its return, depending on which event occurs first.
- The Customer is responsible for any reduction in the value of the Goods resulting from using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
- The right to withdraw from the contract is not available in the cases specified in the Consumer Rights Act, in particular in relation to Goods:
- non-prefabricated, manufactured according to the customer's specifications or intended to meet his individual needs,
- that deteriorate quickly or have a short shelf life,
- delivered in a sealed package which, once opened, cannot be returned for health protection or hygiene reasons,
- which, after delivery, due to their nature, are inseparably combined with other items.
§10. Account and Newsletter
- Creating an Account is voluntary.
- The Customer may delete the Account at any time by contacting the Seller.
- The newsletter is sent only to people who have agreed to receive it, if such consent is required by law.
- You can unsubscribe from the Newsletter at any time by clicking the appropriate link in the e-mail or contacting the Seller.
§11. Product reviews
- The Seller may enable Customers to add opinions about the Goods.
- Opinions should be consistent with the law, good practices and must not violate the rights of third parties.
- The Seller may take steps to verify whether the opinions come from people who actually purchased the Goods.
- The Seller does not publish or commission the publication of false opinions.
§12. Personal data
- The administrator of Customers' personal data is the Seller.
- Personal data is processed in accordance with applicable law, in particular the GDPR.
- Detailed rules for the processing of personal data, including the purposes, legal basis and rights of data subjects, are set out in the Privacy Policy available on the Store's website.
§13. Out-of-court methods of resolving disputes
- The consumer has the opportunity to use out-of-court methods of dealing with complaints and pursuing claims, in particular through:
- applying to the competent provincial inspector of the Trade Inspection,
- using the assistance of a permanent arbitration court at the Trade Inspection,
- using the help of a municipal or district consumer ombudsman,
- using other relevant institutions dealing with consumer protection.
- Detailed information on out-of-court dispute resolution methods is available on the websites of the Office of Competition and Consumer Protection and relevant ADR entities.
§14. Final provisions
- Polish law applies to contracts concluded via the Store.
- In matters not regulated in the Regulations, generally applicable provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
- The Regulations do not exclude or limit any rights of the Consumer or the Entrepreneur under consumer rights arising from mandatory provisions of law.
- The change in the Regulations does not affect the acquired rights of Customers who concluded contracts before the entry into force of the amended Regulations.
- The Regulations come into force on the day of publication on the Store's website (i.e. March 10, 2026).
